Really Important Copyright Information
Please note the following important information regarding copyright and how it has been applied to this site.
All the images contained on this site have been scanned directly from the original source material which I own (i.e. it is not sourced from other people's web sites with or without their permission. However, this does not mean that the copyright for these items rests with me, therefore please note the following if you intend to take any images from the site and please please please do not use any images for any commercial reasons. This is a not-for profit history website and not a commercial enterprise. Enjoy it as a celebration of Scarborough, pass the web address to your friends and family but avoid doing anything that would jeopardise its existance.
If an image is from before 1923 my understanding of UK copyright law is that it is regarded as being public domain (i.e. it is out of copyright). This applies to the majority of the cards on the site including all the steroviews and maps but not all of the postcards.
Where cards have been published between 1923 and 1964 (50 years before now) then the copyright has been assumed to rest with the postcard publisher and not the photographer and its has also been assumed that it was not renewed which I understand was very rarely done. My understanding is that the postcard images becomes public domain 50 years after the date of publication (which in the majority of cases is assumed to be no earlier than the date of posting although in reality it may have been much earlier than this. If this is not the case and if you own the copyright and wish me to remove a card from the site then I will do so immediately and without question.
Where cards were published in the last 50 years, I have attempted to track down the current copyright owner to seek their permission to use the images on the site. As many of the postcard companies have now gone into liquidation and their assets have been bought by third parties it has been quite a challenge to track the new owners down. If I have not been in touch and got your permission it is not for lack of trying and if you spot an image and wish to have it removed, I will once again do it without hesitation if you email me or call me or fill in the form below.
I have included the card backs for all the postcards on this site which helps identify the original copyright owner (although not necessarily the current owner). Please check the back of the card to see if the publisher is identified and if you do wish to use an image or download it for anything other than personal use please drop me a line and I will try and put you in touch with current copyright holder if I have their email address or contact details.
